1. Scope
All legal transactions that are concluded via the online shop www.shop.revierhotels.com (hereinafter referred to as “online shop”) fall under the general terms and conditions (hereinafter referred to as “GTC” or “GTC - online shop”). This online shop is run by the stock corporation "REVIER Hospitality Group AG" (hereinafter referred to as "RHG"). RHG reserves the right to change these terms and conditions at any time. The version valid at the time of the order is authoritative.

2. Offer
The products and prices in the online shop are considered offers. The offer is valid as long as the product can be found in the online shop and is in stock.

3. Products and Prices
RHG can set the prices freely and change them at any time. When ordering, the price published on the website is decisive. If prices have been published in error, RHG reserves the right to notify the customer (in the following for improved reading flow only “customer”) prior to dispatch in order to agree a price correction or to cancel the order.
The prices are given in CHF, EUR or AED as standard. The conversion rates correspond to the daily rate.
The shipping and packaging costs are calculated and shown separately from the offer price. Any cash on delivery of the selected logistics partner is entirely at the expense of the customer.

4. Information Provided
RHG tries to keep the data published in the online shop up to date and correct. However, there may be delivery delays due to production / delivery bottlenecks and sales via other channels. Therefore, all information on availability and delivery time are without guarantee and can change at any time.
RHG assumes no liability for the correctness or the topicality of the information provided by other manufacturers, even if this has been carefully researched. 

5. Conclusion of a contract
The purchase contract is concluded by sending the order (online) and accepting it by RHG.
A prerequisite for a valid sales contract is the complete and truthful completion of the order form provided on the Internet and acceptance of the general terms and conditions (GTC - online shop).
RHG confirms receipt of the order with an automatically generated order confirmation by email. This only indicates to the customer that the order has been received and that the purchase contract has been concluded on the condition that delivery is possible and that the price is correct.

6. Terms of delivery and collection

6.1 Availability and delivery
Products marked as “available” are usually delivered within 2-5 working days between Monday and Friday from receipt of the order or can be picked up at the hotels (REVIER Mountain Lodge Lenzerheide or REVIER Mountain Lodge Adelboden). If a product is not in stock or is incorrectly marked as “available”, the customer will be notified by email or telephone and a new provisional delivery or collection date will be agreed. RHG strives for a quick subsequent delivery and sends back goods.
If an article is no longer available and can no longer be procured or produced by RHG, RHG can withdraw from the contract, but must fully reimburse the customer for payments already made for the product in question.
If RHG is unable to provide or ship the items within 30 calendar days of receipt of the order, the customer has the right to withdraw from the contract. Payments already made by the customer to RHG for the product in question will be fully refunded. There are no further claims against RHG.
If additional shipping costs are incurred due to an incorrect delivery address or incorrect address data, these costs are entirely borne by the customer.
Unless otherwise agreed, RHG sends national and international orders with Swiss Post. The provisions, information and delivery times of Swiss Post apply.

6.2 Additional provisions for delivery
If the customer does not accept the goods delivered by the supplier within the agreed or specified delivery periods, RHG can withdraw from the contract, cancel the order and charge the customer a processing fee of 15%, but at least CHF 30.-.

6.3 Additional provisions for collection
If the customer chooses the "pick up" option when ordering, they will receive a confirmation. If the customer does not pick up the ordered products within 10 working days of receipt of the confirmation, RHG can withdraw from the contract and charge the customer a processing fee of 15%, but at least CHF 30.-. 
 
7. Obligation to inspect
The delivered or picked up products are to be checked by the customer for completeness, correctness and delivery damage immediately after acceptance. If there is a defect, RHG must be notified of this within 7 calendar days and the product must be in its original condition to be returned.

8. Warranty conditions and services
RHG has no influence on the shelf life and functionality of the products or the guarantee of other manufacturers. The manufacturer's guarantee information therefore applies, provided they are valid in Switzerland.
In addition, the Swiss statutory warranty provisions in accordance with Art. 197 ff. OR apply.
A guarantee claim can only be made by the customer upon presentation of the purchase contract including a valid order form.
There is no guarantee claim for damage caused by improper handling or defects that can be traced back to external influences. This could, for example, be damage caused by natural forces, moisture damage, fall and impact damage or damage caused by modifications.
RHG can provide the guarantee by replacing the product as good as new.

9. Liability and Disclaimer
RHG is only liable for the guarantee services that are specified under no. 8 are listed. Any further liability is excluded, in particular liability for damage that did not occur on the products themselves. This can be indirect and indirect damage and consequential damage such as lost profit, unrealized savings, or damage from delayed delivery. In addition, RHG is not liable for damage caused by improper storage.

10. Payment
The invoice must be paid in the selected currency and immediately upon completion of the order. The following payment methods are accepted in the online shop: Credit cards via the Concardis payment platform (VISA and MASTERCARD).

11. Right of withdrawal and right of withdrawal
The right of cancellation is regulated in the cancellation policy.

12. Data protection
RHG only collects personal data that is necessary for the conclusion of the contract.

13. Application of law and place of jurisdiction
The relationship between RHG and the customer is exclusively subject to Swiss law. The place of jurisdiction is Vaz / Obervaz (CH).
